Massachusetts Waterfront Structures — Chapter 91, the Simplified License, and What Great Ponds Change

Standard path — Simplified License:

310 CMR 9.10. Structure ≤600 sq ft below mean high water.
Built/altered after Jan 1, 1984. Form BRP WW06.

Smaller path — §10A:

310 CMR 9.07 + 9.02 exclusion. No piles, expires Dec 31, town must run a §10A program (not every town does — check first).

Neither fits:

Request for Determination of Applicability: WPA Form 1.

The Great Ponds wrinkle:

MA great ponds are Commonwealth land in their entirety. Ch. 91 + state WPA only cover two of the layers you need. The other four: town local wetlands bylaw, MESA/NHESP endangered-species review, USACE Massachusetts General Permit, M.G.L. c.131 §45. A permit clearing only Ch. 91 is not complete on a great pond — check all six.
